Sen. Cruz Agrees To Present Oral Argument If Supreme Court Decides To Hear PA Case

Sen. Ted Cruz (R-TX) threw his support behind an effort to get the Supreme Court to hear an appeal of a ruling dismissing a Republican-led challenge of Pennsylvania’s mail-in voting system.

“This appeal raises serious legal issues, and I believe the Court should hear the case on an expedited basis,” the Texas Senator said in a statement last week.


The lawsuit revolves around the claim that millions of ballots in Pennsylvania should be thrown out. The GOP’s argument is that the law allowing voters to cast mail ballots for any reason violates the state constitution’s requirements for who is eligible to receive a mail-in ballot.

The petitioners, led by Rep. Mike Kelly (R-PA), who brought the original suit, filed an emergency request to the Supreme Court asking it to stop any further certification of the Pennsylvania vote.

Senator Cruz said in part that the petitioners’ case “raises serious legal issues” and urged the high court to “hear the case on an expedited basis.”

On Monday, Fox News’ Chief Congressional Correspondent Mike Emanuel reported, “If the Supreme Court decides to take up the case, a high profile U.S. Senator will be arguing in front of the high court. Texas Senator Ted Cruz telling Fox News exclusively, ‘Petitioners’ legal team has asked me whether I would be willing to argue the case before the Supreme Court, if the court grants certiorari. I have agreed and told them that, if the Court takes the appeal, I will stand ready to present the oral argument.” Continued Below

Because of the importance of the legal issues presented, I’ve publicly urged #SCOTUS to hear the case brought by Congressman Mike Kelly, congressional candidate Sean Parnell & state rep. candidate Wanda Logan challenging the constitutionality of the POTUS election results in PA.

Petitioners’ legal team has asked me whether I would be willing to argue the case before #SCOTUS, if the Court grants certiorari. I have agreed, and told them that, if the Court takes the appeal, I will stand ready to present the oral argument.

As I said last week, the bitter division and acrimony we see across the Nation needs resolution. I believe #SCOTUS has a responsibility to the American People to ensure, within its powers, that we are following the law and following the Constitution.
